1. Service Description

Brian Kight's Coaching Tool ("the Service") provides on-demand coaching tools built on Brian Kight's proven methodology. The Service enables coaches to generate documents, engage in coaching conversations, and build resources for their programs. The Service is operated by DIGNVS Technologies LLC ("we," "us," or "our").

2. Account Terms

  • You must be at least 18 years old to use Brian Kight's Coaching Tool.
  • Each account is for a single person. You may not share your login credentials with others.
  • You are responsible for maintaining the security of your account and password. We cannot and will not be liable for any loss or damage from your failure to comply with this obligation.
  • You are responsible for all activity that occurs under your account.

3. Subscription and Billing

  • Brian Kight's Coaching Tool is offered as a paid subscription on an annual billing cycle.
  • Subscriptions auto-renew at the end of each billing period unless you cancel before the renewal date.
  • All payments are processed securely through Stripe. We do not store your credit card information on our servers.
  • Prices may change with 30 days' notice. Existing subscribers will be notified via email before any price changes take effect.

4. Refund Policy

  • Full refund within 14 days of initial purchase.
  • Prorated refund for annual plans within 30 days.
  • No refunds after 30 days.

5. Content Ownership

You retain full ownership of all content you create or generate using Brian Kight's Coaching Tool. We do not claim any intellectual property rights over your generated documents, chat conversations, or any other content you produce through the Service.

Brian Kight's frameworks, methodologies, and proprietary content used within the Service remain the intellectual property of Brian Kight and his affiliated entities.

6. AI-Generated Content Disclaimer

Content is AI-generated using Brian Kight's methodology. While we strive for accuracy, outputs should be reviewed before use. BK Brian Kight's Coaching Tool is not a substitute for professional legal, medical, or psychological advice.

You are solely responsible for reviewing, editing, and approving any AI-generated content before distributing it to your athletes, staff, or organization.

7. Acceptable Use

You agree not to:

  • Use the Service for harassment, abuse, or any illegal purpose.
  • Generate content that is illegal, harmful, threatening, or discriminatory.
  • Attempt to extract, reverse-engineer, or reproduce system prompts, training data, or proprietary methodology.
  • Share your account credentials with others or allow others to access your account.
  • Use automated tools, bots, or scripts to access the Service without our written permission.
  • Interfere with or disrupt the integrity or performance of the Service.

8. Data Handling

Your data is handled in accordance with our Privacy Policy, which describes what data we collect, how we use it, and how we protect it. By using the Service, you agree to the data practices described in our Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by applicable law, BK Coaching Tools, its owners, operators, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill.

In no event shall our aggregate liability for all claims relating to the Service exceed the amount you paid us in the 12 months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Termination

  • You may cancel your subscription and delete your account at any time from your Settings page.
  • We reserve the right to suspend or terminate your account if you violate these Terms of Service, with or without prior notice.
  • Upon termination, your right to use the Service ceases immediately. Your data will be handled in accordance with our Privacy Policy.

11. Changes to These Terms

We may update these Terms of Service from time to time. When we make material changes, we will notify you via email at the address associated with your account. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in the State of Ohio.
